After much prayer, family conversation and deliberation, Carole C. Smitherman, Esq., qualified for Circuit Judge Place 13 on Friday, January 13, 2012.  Two years ago, Smitherman seriously considered asking the people to allow her the opportunity.  However, Councilor Smitherman had projects and district appointments she wanted to implement and explore.  

“Now, with the people’s permission, this is the best time to return to my service on the bench.  The City and district are progressing well and for that I am thankful,” said Smitherman. “The Law is my passion.


Smitherman served as the first female Birmingham Municipal Court Judge and the first African-American in the State to serve as a Circuit Judge.  She has nearly 30 years service to the Alabama Bar.  She is married to State Senator Rodger Smitherman, the former President Pro Tempore of the Alabama Senate, and together they have four children.

Smitherman is in her third term on the Birmingham City Council.  She has served as Council President, Council President Pro Tempore, Chair of Budget and Finance, Chair of Economic Development and Interim Mayor.
